Terms of Service — FakeDono

    Plain English summary: FakeDono is a prank and entertainment tool. Use it responsibly — don't use it to commit fraud, harass anyone, or cause genuine financial harm. You're responsible for how you use it. We can suspend accounts that break these rules.
  

1. Acceptance of Terms

By accessing or using FakeDono ("the Service") at fakedono.wtf, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

FakeDono is operated by Foeky ("we", "us", "our"). These Terms form a legally binding agreement between you and FakeDono.

2. Description of the Service

FakeDono is a browser-based entertainment and creative tool that generates text-to-speech (TTS) audio in the format of streaming donation alerts. It is designed for use in pranks, reaction videos, comedy content, and creative projects.

The Service does not interact with any live streaming platform (Twitch, YouTube, Kick, etc.), payment processor, alert overlay service, or chat system. It generates audio output locally in the user's browser only.

3. Eligibility

You must be at least 13 years of age to use FakeDono. By using the Service, you represent and warrant that you meet this minimum age requirement.

If you are using FakeDono on behalf of an organisation or business, you represent that you have the authority to bind that entity to these Terms.

4. Acceptable Use

FakeDono is for entertainment only. Using it to commit fraud, cause genuine financial harm, or deceive people in a way that damages them is strictly prohibited and may be illegal.

4.1 Permitted Uses

You may use FakeDono to:

Create prank audio clips for personal entertainment or social media content
Test donation alert audio formats for streaming setup purposes
Create comedy or reaction-based video content
Produce entertainment content where the simulated nature of the alert is clear to the audience

4.2 Prohibited Uses

You must not use FakeDono to:

Commit fraud — Using simulated donation audio to deceive a streamer or any person into believing they received a real donation, gift, or financial payment
Financial deception — Creating content intended to cause someone to make financial decisions based on a false belief in the reality of a donation
Harassment or targeted abuse — Using the Service to harass, intimidate, bully, or distress specific individuals
Impersonation for harm — Simulating donations from real persons in a way that damages their reputation
Illegal activity — Any use that violates applicable laws or regulations, including consumer protection, fraud, and computer misuse laws
Automated abuse — Using bots, scripts, or automated tools to abuse the TTS generation service
Circumventing limits — Creating multiple accounts to bypass Free tier character limits

We reserve the right to determine, at our sole discretion, whether a use case violates these Terms and to take appropriate action, including account suspension.

5. User Accounts

To access most features of FakeDono, you must create an account. You are responsible for:

Maintaining the confidentiality of your password
All activity that occurs under your account
Notifying us immediately of any unauthorised use of your account via our support page

You must not share your account credentials or allow others to use your account.

6. Premium Subscription

FakeDono offers a Premium subscription tier at £1.00 per month (or as otherwise stated at the time of purchase), processed via Stripe.

6.1 Billing

Premium is billed monthly on the date you first subscribed. You authorise us to charge your payment method automatically at the start of each billing period.

6.2 Cancellation

You may cancel your Premium subscription at any time from your account panel. Upon cancellation, your access to Premium features will continue until the end of the current billing period. No partial refunds are issued for unused days in the current period.

6.3 Refunds

All purchases are generally non-refundable. If you believe you were charged in error, submit a support ticket within 7 days of the charge and we will review your case.

6.4 Price Changes

We reserve the right to change Premium pricing. We will provide at least 30 days' notice of any price increase to active subscribers.

7. Intellectual Property

FakeDono and all associated software, design, branding, and content are owned by FakeDono and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Service without our written permission.

Audio generated by FakeDono using your inputs is produced for your personal, non-commercial entertainment use. Commercial use of generated audio may require separate licensing of the underlying TTS voice technology (Amazon Polly / ElevenLabs).

8. Third-Party Services

The Service integrates with third-party services including Supabase, Stripe, Amazon Web Services, Netlify, and optionally ElevenLabs. Your use of these integrations is also subject to the applicable terms and privacy policies of those providers. We are not responsible for the acts or omissions of third-party providers.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. TTS generation depends on third-party AWS infrastructure and may be subject to availability limitations.

10. Limitation of Liability

To the maximum extent permitted by applicable law, FakeDono and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, goodwill, or other intangible losses.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid to FakeDono in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless FakeDono and its operators from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms or are using the Service in a manner that harms others or the Service itself.

You may close your account at any time from your account panel under Settings. Upon account closure, your personal data will be deleted in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes by email and will update the "Last updated" date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
